1. PARTIES

1.1. Hazzit Mkhulu (Pty) Ltd is a registered Private Company as per South African law, and will be referred to as “Hazzit Mkhulu” in this document.

1.2. "User" shall refer to any person accessing this website.

2. INTRODUCTION

2.1. Hazzit Mkhulu's website is www.hazzitmkhulu.co.za, which includes other formats: applications and or mobile sites.

2.2. These terms and conditions apply to the ordering, sale, and delivery of goods offered on the website (referred to as “goods”), as well as the usage of the website.

2.3. The terms and conditions shall hereby be binding on all Users.

2.4. Users hereby acknowledge having read and agreed to these terms and conditions which is legally binding. 

3. IMPORTANT

As per the Consumer Protection Act 68 of 2008 (“CPA”) we would like to emphasise on CPA clauses relating to the Delivery of Goods, Payments, Privacy Policy, Disclaimer and the Limitation of Liabilities. 

This shall confirm the below:

3.1 Limited liability and or risk of Hazzit Mkhulu in relation to the use of the website by Users;

3.2 The User assumes risks in the use of our website;

3.3 It is the User/s responsibility to familiarise themselves with these terms and conditions and request assistance to understand them fully (if required);

3.4 By the use of the website: www.hazzitmkhulu.co.za - Users accept all  terms and conditions unconditionally. 

4. CONCLUSION OF SALES & STOCK AVAILABILITY 

4.1. Orders may be accepted/rejected by Hazzit Mkhulu based on the availability of stock, information relating to goods and services including pricing and the receipt of payments due.

4.2 Acceptance of an order (which only allows for delivery of such goods ordered; as there is no collection allowed at this stage of the business) confirmed with payment, will allow Hazzit Mkhulu to cancel an order and refund the User at any time. 

4.3 Users may cancel orders subject to no dispatch of goods having been made. Return of goods must abide by the Returns Policy.

4.4 Mere adding goods to the Shopping Basket will not finalise an order as payment and completion of the transaction is required to secure, yet cancellation of items may be processed if there is no stock available, whilst Hazzit Mkhulu will not be liable for any losses incurred by the User due to stock not being available and price changes at any time and or cancellations of orders for whatever reason. 

4.5 Users understand that stock may be limited and prices are subject to change without notice and stock availability cannot be guaranteed. Unavailability of stock will result in the User being notified and a refund being made to the User. 

4A. ORDERS & CONFIRMATION

1. When you place an order on this website, you agree to the terms and conditions that apply on that day. We may update these terms from time to time, so it’s your responsibility to read the latest version each time you order.

2. We try to show our products as accurately as possible, but because screen displays vary, we can’t guarantee that the colours you see will match the actual product exactly.

3. Placing an order creates a legal commitment. Refunds are only given according to our terms and conditions. Please only place an order if you understand and accept these terms.

4. You agree that any orders or messages sent to Hazzit Mkhulu electronically—whether by you or someone you’ve authorised—will be treated as genuine, even if there are errors due to system issues or other technical problems. You will be bound by what we receive, and we will not be responsible for any differences between what was sent and what we received.

5. You give up any right to claim against Hazzit Mkhulu for any loss or damage that results from us acting on your order or instruction, even if it didn’t come directly from you. You also agree to cover any costs or losses we face as a result of following those instructions.

6. Once payment is made for an order, we will assume you’ve read, understood, and accepted the terms and conditions. It’s your responsibility to provide the correct delivery address. Once the order leaves our premises, ownership and risk pass to you.

7. We will only process your order once we confirm the product is available and full payment has been received.

8. Your order is not final until you receive an official confirmation from us after we’ve received payment.

9. Hazzit Mkhulu acts as a sourcing partner and does not keep stock. All orders depend on the availability of stock from our suppliers. If demand is high or stock is limited, we may not be able to supply the full quantity you ordered. In such cases, we may limit the order or delay delivery.

10. We reserve the right to refuse service or cancel an order at our discretion, to the extent allowed by law. We may reject an order—even if payment has been made—by contacting you via phone or email within a reasonable time. We may also change or cancel an accepted order before delivery by notifying you, without owing any penalty or damages. If we cancel an order you’ve paid for, we’ll refund the payment as soon as possible.

11. We’ll do our best to fulfill your order exactly, but if a product is out of stock or replaced by a newer version, we may send you a substitute—if you’ve agreed to that. If we can’t supply part of your order right away, you can choose to wait for the item to come back in stock or cancel that part and get a refund.

12. Please make sure you use the correct Hazzit Mkhulu product codes or item numbers from our website when placing an order.

5. PAYMENTS

5.1 Payments will be processed Online using: Debit Cards, Credit Cards, EFT and by Direct Cash Deposits. Standard banking security & online payment rules and regulations shall apply.

6. GOODS & DELIVERIES

6.1 Currently Hazzit Mkhulu only delivers goods using courier services. 

6.2.  Delivery costs are subject to change and at any time without notice to the User. 

6.3  Delivery costs are stated on our website when finalising purchases at the User cart stage, when the User Checks Out. 

6.4 Additional delivery charges will be communicated for larger and heavier packages as costs on the website may only indicate costs for standard size and weighted products. Users will be contacted to make any necessary additional payments for larger and heavier items. 

6.5 Normal delivery turnaround time is between 2 - 5 working days. We will notify Users should we not be able to deliver within this standard time period and an alternative solution will be offered to the User.

6.5a Hazzit Mkhulu will do its best to deliver your order by the date you request. If we can’t meet that date, we’ll try to let you know. However, we won’t be responsible for any loss, cost, or damage caused by a delayed delivery.

6.5b If your order is returned to Hazzit Mkhulu because it couldn’t be delivered, we’ll try to contact you to arrange a new delivery. We’ll only resend the order once you’ve paid an additional delivery fee.

6.5c Please note that Hazzit Mkhulu may not be able to deliver to certain areas. If that happens, we’ll contact you using the details you provided to arrange an alternative delivery option.

6.5d Hazzit Mkhulu uses standard packaging for deliveries. If you request special packaging (where possible), extra charges may apply. Delivery fees can vary depending on your area, region, or country. Hazzit Mkhulu also reserves the right to deliver your order in parts.

6.5e If you won’t be available to receive or collect your order, please let Hazzit Mkhulu know at least two working days in advance so we can make other arrangements.

6.5f You will need to sign when you receive your delivery. Please check the products for any visible damage or defects before signing. We recommend keeping your delivery receipt in case you need to discuss your order with Hazzit Mkhulu later.

6.5g Please be careful when opening your products, especially if you use sharp objects. Hazzit Mkhulu is not responsible for any damage or costs caused by careless handling when opening packages.

6.5h If products are delivered to your usual business address, the risk of loss or damage passes to you once the delivery is made. If you don’t accept the delivery, the risk passes to you when the courier tries to deliver. For products you pick up from a Hazzit Mkhulu partner, the risk passes to you when you collect the items. If you refuse to accept delivery, you will be responsible for any costs or losses that result.

6.5i You don’t own any products until you’ve paid the full purchase price and any other amounts you owe Hazzit Mkhulu (with cleared funds). If you’re late with payment, Hazzit Mkhulu can ask for the return of any products that aren’t fully paid for. You also give Hazzit Mkhulu permission to collect those products and enter your premises if needed.

6.5j While Hazzit Mkhulu still owns the products:

(a) You must, at your own cost, insure the products against all risks for an amount we reasonably require. Any rights from this insurance are considered security for what you owe us.

(b) If you receive an insurance payout for these products, you must pay us the amount of the payout, up to the amount you still owe.

(c) The products will not become part of the property or building where they are placed or installed, no matter how they are fixed.

(d) The products must stay at the location and cannot be moved without our written permission.

(e) You must inform the landlord right away that the products belong to us and are not subject to any landlord’s claim or lien. Hazzit Mkhulu asking for or taking back the products does not cancel your responsibility to pay for them in full or our right to sue for payment.

Hazzit Mkhulu may stop supplying any product or change its design at any time without notice as part of ongoing improvements or to ensure availability. The latest details on products and designs can always be found on our website. Unless we confirm it in writing, nothing on the website or in any catalogue should be taken as a guarantee about where or how the products were made.

6.6 Hazzit Mkhulu shall deliver ordered products to the physical address provided by the User and Hazzit Mkhulu shall not be responsible for any loss or unauthorised usage of delivered products after delivery to the physical address provided by the User. 

6.7 Delivery of product to the physical address provided by the User thus concludes our obligations at time of delivery. Thus ownership, benefit, and risk relating directly/indirectly to the goods will transfer from Hazzit Mkhulu to the User at the point of delivery at the User's selected physical address.

6.1.A. PRICES

1 Unless stated otherwise in these terms, the product prices shown on this website are current estimates. We confirm our prices as estimates as there may be a delayed update of prices on our website due to late updates received from our suppliers/manufacturers. There are instances where our suppliers/manufacturers do not inform resellers/distributors of price changes timeously resulting in prices being updated later than we would have preferred. Thus we will inform clients of price changes when ordering or finalising an order. We may update prices at any time without warning. If you see different prices in a printed catalogue, keep in mind that those may change too. As we are subject to immediate price changes of our suppliers/manufacturers. 

2 The final price for any product or service will be confirmed in writing when we accept your order. If there are any discounts, they’ll also be included in that confirmation. For items you order to be delivered at a later date (also called “forward orders”), the price may still change after the order is accepted. If that happens, we’ll let you know in writing.

3 All listed prices do not include VAT, yet represent total price of the product, excluding delivery costs. Hazzit Mkhulu is not registered for VAT.

6B. PAYMENT & PRICES

1. All transactions on this website will be processed in South African Rand (ZAR).

2. Prices shown for products on this site can change at any time without warning.

3. If Hazzit Mkhulu hasn’t given you a credit account, you’ll need to pay by EFT (electronic funds transfer) or credit card when placing your order.

4. You can pay using Visa, MasterCard, Diners Club, or American Express cards. You can also pay by bank transfer—bank details will be given if you ask for them.

5. All payments must be made in full. You can’t subtract any amounts you think we owe you or delay payment for any reason.

6. If you don’t pay on time, the following may apply:

a) Everything you owe us becomes due immediately, even if it wasn’t supposed to be paid yet.

b) We can claim back all costs we spend on collecting the money, including legal fees.

c) We may also charge interest on the overdue amount, from the due date until it's paid in full. The interest rate will be 4% or more above the current prime overdraft rate.

d). A certificate signed by a director or manager at Hazzit Mkhulu that shows how much you owe will be enough proof in court unless you can show it’s wrong. This applies to all legal steps we may take to recover the money, including quick judgment processes.

7. RETURNS & REFUNDS POLICY

7.1 Product Quality

Hazzit Mkhulu warrants that the products supplied will, at the time of delivery, be free from manufacturing defects, delivered in good condition, and correspond with the quantities ordered or supplied. Any return is subject to this policy and, where applicable, management approval.

7.2 Reporting Defects

If you believe a product is defective, damaged or incorrect, you must notify Hazzit Mkhulu in writing within two (2) days of delivery.

The product must be kept in its original condition and made available for inspection by Hazzit Mkhulu or its authorised representative within a reasonable time. In accordance with the Consumer Protection Act and these Terms and Conditions, Hazzit Mkhulu may, at its discretion and where legally permitted, repair, replace or refund a defective product.

7.3 Conditions for Returns

Unless otherwise required by law, returned goods must:

Be in their original packaging;

Be unused, unopened and uncontaminated;

Be returned in the same condition as supplied.

For packaging products, any use, contamination, damage, repacking, or opening of the packaging will render the goods ineligible for return unless the return is due to a confirmed manufacturing defect.

7.4 Non-Returnable Products

The following products cannot be returned or refunded unless required by applicable consumer protection legislation:

Gifts;

Food products;

FMCG goods;

Food Packaging;

Cleaning products;

Custom-made products (including acrylic products and personalised gifts);

Printed or branded products;

Goods delivered in good order and accepted by the customer, their staff or authorised representative.

Products that have been used, partially consumed, opened or depleted will be regarded as accepted and are not eligible for return or refund.

7.5 Eligible Returns

Returns will only be accepted where:

The incorrect product was supplied;

The product was damaged upon delivery; or

The product contains a material manufacturing defect or imperfection that renders it unsuitable for its intended purpose or below the standard reasonably expected.

Where applicable, defects may be subject to confirmation by the manufacturer or supplier.

7.6 Remedies

Where a valid claim is accepted, Hazzit Mkhulu may, at its election:

Repair the product;

Replace the product with the correct or equivalent product (subject to stock availability); or

Refund the purchase price if repair or replacement is not reasonably possible.

Replacement goods will correspond with the original order.

7.7 Supplier Approval

Where goods must be returned to the supplier or manufacturer for assessment, any refund will only be processed after the supplier or manufacturer has accepted the return. Should the supplier approve only a partial refund, Hazzit Mkhulu's refund to the customer will be limited accordingly, less any applicable delivery or collection costs.

7.8 Delivery and Collection Costs

Refunds do not include delivery, collection, courier, transport or other incidental costs associated with the original delivery or return of the goods unless otherwise required by law.

7.9 Cancellation and Discretionary Returns

Where Hazzit Mkhulu has supplied goods correctly and in accordance with the order, but agrees, at its sole discretion, to accept a cancellation or return for reasons unrelated to defects, a cancellation or returns fee of up to 45% of the selling price may be charged.

For purposes of calculating this fee, the original selling price shall include any discounts granted, waived delivery charges, artwork or design fees, promotional items, or any other costs waived at the time of sale.

This clause applies only where:

Hazzit Mkhulu has fully complied with its obligations;

The goods are returned unused, unopened and in their original packaging; and

The return is accepted solely at management's discretion.

Goods that have been opened, used, repacked, damaged or partially consumed are not eligible for discretionary returns or refunds.

7.10 No Exchanges or Credits

Hazzit Mkhulu does not exchange returned goods for different products and does not apply refunded amounts as credit towards other purchases unless required by law.

7.11 Information Required for Claims

To assess a claim, Hazzit Mkhulu may require:

A detailed description of the defect or damage;

The delivery note or invoice number; and

Any additional information reasonably required to investigate the claim.

7.12 Exclusions

A repair, replacement or refund may be refused where inspection shows that the product:

Was misused, abused or negligently handled;

Was improperly stored or maintained;

Was damaged through accident;

Was altered, repaired or modified by an unauthorised person;

Was used contrary to Hazzit Mkhulu's or the manufacturer's instructions; or

Has become worn through normal use.

Where a claim is rejected, Hazzit Mkhulu may recover the reasonable costs of inspection, repair, collection and delivery. To the fullest extent permitted by law, Hazzit Mkhulu shall not be liable for any resulting loss, damage or expense.

7.13 Return Procedure

Claims must be submitted in writing before goods are returned.

Returned goods must be packaged securely and returned or made available for collection in accordance with Hazzit Mkhulu's instructions. Products returned without following this procedure may be refused and returned to the customer at the customer's expense.

7.14 Ownership of Replaced Goods

Any product replaced by Hazzit Mkhulu becomes the property of Hazzit Mkhulu. Ownership of the replacement product passes to the customer upon delivery. Any remaining warranty period applicable to the original product will apply to the replacement product.

7.15 Warranties and Limitation of Liability

Except as expressly provided in these Terms and to the extent permitted by applicable law, all other warranties, representations and conditions, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or satisfactory quality, are excluded.

The remedies set out in this Returns and Refunds Policy constitute the customer's exclusive remedies in respect of defective products or services, except where otherwise required by the Consumer Protection Act or other applicable legislation.

Customers remain responsible for ensuring that the products or services ordered are suitable for their intended purpose.

8. PRIVACY POLICY

8.1. Hazzit Mkhulu shall always respect User privacy and take reasonable measures to protect our clients. 

8.2 Hazzit Mkhulu shall require User consent to: 

8.2.1 use User information for any purpose other than for the ordering, sale, and delivery of goods

8.2.2 make contact with User to discuss current/new goods on offer by its divisions, affiliates and or partners unless User has opted out for such contact. 

This may include: to inform of new special offers, and promotional competitions offered by any of Hazzit Mkhulu’s divisions, affiliates, and/or partners, improve our business via monitoring browsing habits and recording purchases by User, unless the User has opted out from this form of marketing or recording. 

8.2.3 Disclose User personal information to third parties unless as per below allowances:

8.2.3.1 to a Hazzit Mkhulu employee and or third party service providers that assist us in client interactions online (website/app/mobile), emails and or other methods for ordering items or when delivering goods to user, requiring the sharing of such relevant information to assist us to communicate with User as required during the normal course of business,

8.2.3.2. to Hazzit Mkhulu’s divisions, affiliates, and/or partners (including Hazzit Mkhulu’s employees and/or third-party service providers) in order for Hazzit Mkhulu to do business directly with Users via email or any other method for the purposes of sending the User marketing material regarding any current or new goods or services, new features, special offers, or promotional items offered (unless the User has opted out from receiving marketing material from Hazzit Mkhulu);

8.2.3.3 to law enforcement, government officials, fraud detection agencies, or other third parties when Hazzit Mkhulu is required to do so by law or in accordance with Hazzit Mkhulu’s Terms and Conditions;

8.2.3.4 to contracted service providers that Hazzit Mkhulu employs to assist it with its business operations, such as for research, statistical analysis, and the implementation of the services that Hazzit Mkhulu provides to Users,

8.3 Hazzit Mkhulu will treat the User’s personal information as confidential,

8.4 Hazzit Mkhulu will retain the User’s personal information only for as long as it is necessary to fulfill the purposes for which it was collected,

8.5 Hazzit Mkhulu will not make the User’s personal information available to any third party outside the scope of this Privacy Policy,

8.6 Hazzit Mkhulu will protect Users personal information, yet cannot guarantee safety of such personal information from unlawful online breaches by third parties, for example in the event of a hacking. Thus, Hazzit Mkhulu will not be liable for any loss or damages, however incurred, as a result of unauthorized access to the User’s personal information.

8.7 Hazzit Mkhulu shall not be liable for losses/damages arising from the User disclosing any personal information to any third parties, also to include persons directly or indirectly connected to Hazzit Mkhulu, 

8.8  Hazzit Mkhulu uses cookies to collect information in order to provide services to the users.

1. When you visit this website, you confirm that you have the legal right to use it, view the information it provides, and buy or order products from it. This confirmation is made to Hazzit Mkhulu (Pty) Ltd, a company registered in South Africa, as well as its related businesses.

2. By using this website, you agree to follow the terms and conditions listed here. If you keep using the site, we assume you fully accept these terms. If you don’t agree with all of them, please stop using the site.

3. Hazzit Mkhulu owns and manages this website. Unless we say otherwise, you can only use the site to look at information and make real, honest purchases. 10.1 Hazzit Mkhulu may make changes to these Terms and Conditions at any time. 

10.2 It is the responsibility of Users to check these terms and conditions regularly for change.

10.3 Users indicate automatic acceptance of all terms and conditions at time of usage of this website.

10.4 Website usage and any other form of electronic communications with Hazzit Mkhulu shall be viewed as User consent to receive all types of communication from Hazzit Mkhulu and subject to provisions of our privacy policy. 

11. COPYRIGHT & OWNERSHIP

All content which shall include text, graphics and logos shall remain property of Hazzit Mkhulu, all third parties concerned and shall be protected by South African law.

Hazzit Mkhulu may update or change the website, its products, services, or content at any time without prior notice.

12.1  Users shall bear all risks associated with the usage of this website. 

12.2  Hazzit Mkhulu cannot guarantee the accuracy or efficacy of information on this website and shall not be liable for any damages to the User for using the website.

12.3 Website information is provided without any guarantee or warranties of any nature.

12.4 We exclude ourselves from any responsibility for losses/damages caused by any electronic viruses or similiar whilst Users use the website.

13. LIMIT OF LIABILITY

13.1. Hazzit Mkhulu shall be exempt from any liability due to inaccurate information and or pricing errors published on the website.

13.2. The User hereby agrees that Hazzit Mkhulu is exempt from any claims related to the Users use of the website

13A. DISPUTE RESOLUTION

a) If a dispute arises under this agreement and cannot be resolved through normal discussions between the individuals involved, the matter will be referred to the most senior representatives of each party. They will meet in good faith to try to resolve the issue within one week (or longer if agreed in writing).

b) If this meeting does not resolve the dispute, either party may propose in writing that a mediator be appointed to help facilitate structured negotiations.

c) If the parties cannot agree on a mediator, or the chosen mediator is unavailable, either party may request the Arbitration Foundation of South Africa (AFSA) to appoint a mediator within seven days.

d) Within seven days of the mediator being appointed, both parties will meet with the mediator to agree on a plan for sharing information and the structure of the negotiations. These meetings will take place in Pretoria or Johannesburg.

e) All discussions and negotiations related to the dispute will be confidential. The parties agree not to share any details except with their professional advisors, who will also be bound to keep the information confidential.

f) If the parties reach an agreement (including accepting the mediator’s recommendations), the agreement must be written down and signed by authorised representatives. Once signed, it will be final and binding.

g) If no agreement is reached, the mediator may, at the parties’ request, provide a non-binding written opinion on the dispute. This opinion is private and cannot be used in future legal proceedings unless both parties agree in writing.

h) If the structured negotiations fail to resolve the dispute within 30 days of the mediator’s appointment, either party may take the matter to court. Nothing in this process prevents either party from approaching a court for urgent relief if necessary.

13B. CANCELLATIONS 

Hazzit Mkhulu may, at its sole discretion and without needing to provide a reason, decline to process any payment or cancel any order—whether in full or in part—particularly in cases of suspected fraud, stock unavailability, or for any other reason. If this happens, you will be informed, and any payments already made will be refunded. Hazzit Mkhulu will not be held responsible for any resulting losses or consequences arising from such a cancellation.

No cancellation penalties or charges will apply.

Hazzit Mkhulu also retains the right to enforce a "no cancellations" or "no returns" policy at any time and is not required to provide a justification for doing so.

14. FORCE MAJEURE

Hazzit Mkhulu will not be held responsible for any failure, delay, or interruption in fulfilling its obligations that results from circumstances beyond its reasonable control. These may include—but are not limited to—natural disasters, pandemics, civil unrest, war, acts of terrorism, governmental or legal interventions, cyberattacks, labor strikes, power or internet outages, equipment breakdowns, supply chain disruptions, or severe weather conditions ("Force Majeure Events"), whether or not such circumstances were foreseeable.

If a Force Majeure Event continues for fourteen (14) business days or longer, either party may cancel the affected order by giving written notice to the other. In such a case, neither party will be liable for the cancellation, except that Hazzit Mkhulu will refund any payments made for undelivered products.

In instances where Hazzit Mkhulu is unable to fulfill all customer orders due to a Force Majeure Event, the company reserves the sole discretion to determine how and to what extent it will fulfill any orders, including which contracts take priority.

15. ETHICAL BUSINESS PRACTICES

You agree to adhere to all relevant laws and regulations relating to anti-bribery, anti-corruption, and anti-competitive practices, and you undertake to:

a) not offer, promise, give, solicit, or accept any gift, payment, benefit, or incentive—whether directly or indirectly—to or from any employee, representative, contractor, or agent of Hazzit Mkhulu that may influence, or appear to influence, a business decision, delay, or omission in connection with any transaction;

b) refrain from any action or inaction that could result in Hazzit Mkhulu breaching its legal or ethical obligations; and

c) immediately notify Hazzit Mkhulu of any attempt, request, or suggestion received by you or your representatives that would involve offering or accepting an improper advantage related to the execution or performance of these Terms and Conditions.

16. TERM AND TERMINATION

16.1 All above terms and conditions shall remain binding and applicable to all Users of the website.

16.2. These Terms and Conditions and any policies or operating rules posted by Hazzit Mkhulu in relation to the use of the Website constitute the entire agreement and understanding between Hazziit Mkhulu and the User.

17. WEBSITE OVERSIGHT & USAGE POLICY

Hazzit Mkhulu may track and review how this website is used, including any content posted or shared. If concerns or violations of these terms are identified, Hazzit Mkhulu may take any steps it finds appropriate. This could include limiting or removing access to the site, deleting content, or issuing notices, depending on the situation.

The User shall understand that these terms and conditions are applicable and accepted by the User by the mere usage of the website (www.hazzitmkhulu.co.za).
